Visitors Waiver

SME Industries, Inc. (“SME”) is a private, industrial office and shop facility engaged in the fabrication of structural steel and related products. The office and shop are not open to the public. Visitors are allowed to enter SME’s office and/or shop if such visit has been approved or sponsored by an authorized employee of SME, who should accompany the Visitor at all times.

By signing SME’s Visitor’s Log, Visitor acknowledges and agrees that the SME’s premises contain various industrial equipment, materials, and operations that may pose significant risks, including but not limited to the risk of exposure to physical injury, hazardous substances and other dangers. By signing SME’s Visitor’s Log, Visitor hereby assumes all such risks, whether known or unknown, patent or latent, foreseeable or unforeseeable, associated with entering and being present on SME’s premises.

RELEASE OF LIABILITY

Further, as a condition to being allowed to enter onto SME’s premises, Visitor on behalf of themselves, their heirs, executors, administrators, assigns, and personal representatives, hereby fully and forever releases, waives, discharges, and covenants not to sue SME, its subsidiaries, affiliates, owners, officers, directors, employees, agents, representatives, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, judgments, costs, expenses, attorney's fees, or compensation of any kind or nature whatsoever, whether in law or in equity, that the Visitor may have or acquire against the Released Parties arising out of or related to the Visitor's access to or presence on the premises.

COMPLIANCE WITH INSTRUCTIONS

Visitor also agrees to follow all instructions, rules, and safety protocols established by SME or its representatives while on SME’s premises, including but not limited to:

a)    Wearing appropriate personal protective equipment;

b)    Remaining in designated visitor areas;

c)     Refraining from touching or operating any equipment or machinery;

d)    Complying with all posted signs and warnings; and

e)    Immediately reporting any unsafe conditions or incidents to Company personnel.

AFFIRMATION

Visitor affirms that: (1) he or she is over the age of 18; (2) that he or she has reviewed and understood this Visitor’s Policy, and (3) he or she is willing to be bound by the same as a condition to entering onto SME’s premises. If a visitor is under the age of 18, a legal guardian must sign the waiver form log book on their behalf.
